Acceptable use policy

As a high quality web hosting provider Infinite Hosting values its good reputation. Accordingly, it is important to us that our customers use our services and the Internet in general, responsibly and courteously. Most of our customers do so and seldom need to refer to these AUPs (Acceptable Use Policies). Nonetheless some people will always ignore the rules, for this reason we have outlined below what constitutes unacceptable uses of our service. Breaching this AUP can and may result in the suspension or termination of your the account and all other accounts that you may hold with Infinite Hosting regardless of reseller status or any other status.

General. We expect all of out customers to behave in a polite and courteous manor towards fellow users of the Internet and our services. In order to open an account with Infinite Hosting you must be 18 years of age or older.

Email.

Spam. We take spam mail very seriously, we will instantly suspend an account if we are led to believe the owner is involved in unsolicited bulk mailing regardless of whether they are using our system to carry out their activities or not.

Mailing Lists. We also take very seriously the act of subscribing someone to an electronic mailing list without their prior consent. If you are running a mailing list it is your responsibility to make sure that users whose email addresses are entered actually want to be subscribed to your mailing list, if we receive complaints that you are not doing this we may at our discretion terminate your account.

Mail bombing. Any user that is found to be participating in the act of mail bombing (inundating a user with email without a serious intent to correspond with them) shall have their account terminated. Any user who is repeatedly the subject of such attacks (or attracts such attention) will be asked to leave our system.

Unlawful Use.

General. Unlawful uses of our services includes (but is not limited to): drug dealing; pirating; hacking; cracking; copyright infringement; gambling; distribution of obscene materials; fraudulent activity; sending a message or having content that is obscene, lewd, lascivious, filthy, or indecent with intent to annoy, abuse, threaten, or harass another person; threatening bodily harm or damage to individuals or groups; Infinite Hosting reserves the right to check system files, email, and other data on our servers for illegal content and materials, or for any other reasons deemed necessary.

MP3's. MP3's are acceptable on our servers as long as you personally own the copyright to the material stored therein e.g. You have recorded your band playing your latest track. We will not tolerate the storage, distribution, promotion or linking to of illegal MP3's as these MP3 files constitute a breach of international copyright agreements, such violations shall be taken very seriously and reported to the appropriate authorities. We reserve the right to inspect all MP3 files (or files suspected of being MP3's e.g. Zip files containing them, files with altered extensions).

Pornography. Pornography and sex related merchandising, or links to such material, even if legal, is not an acceptable use of Infinite Hosting servers.

30 Day Money Back Guarantee. If within 30 days of signing up with us, you decide that we are not suitable for your needs or that our service does not meet your expectations you have the right to cancel your account and claim a refund on moneys paid to us. If during the sign up process you asked us to register a domain name with us then the name will remain the property of Infinite Hosting and will be released to you upon receiving payment of £14.95 per year of registration e.g. You selected 10 year registration period during sign up which means you will have to pay £149.50 for us to release the domain to you. The offer of a 30 day money back guarantee is only available to persons who have not had a hosting account with us in the past two years - We will determine this based on details given at the time of signing up with us. After the 30 day period no moneys will be refunded for services not used e.g. You pay for 1 year and leave after 8 months, we will not refund you for the 4 months that you do not use.

Abuse of Server Resources. Abuses of our server resources includes (but is not limited to): Running background tasks without prior written permission; running chat rooms; Internet Relay Chat; IRC Bots; daemons and other executable files; receiving more than 1000 emails a day. Further more any usage of 10% or greater resource usage (CPU, Memory etc.) is an undue burden to our system and is not acceptable - If you do not comply with this ruling then your account may be terminated immediately without notification (You will have the right to appeal to us and no other body). Domains that use more than 10 Gigabytes of transfer bandwidth may be suspended or terminated immediately (If you need more than 10 Gigabytes per month of transfer bandwidth we can arrange this with you). Also unacceptable is the use of scripts to run two web sites from the same account e.g. Pointing two domain names at your space and using a script to point them to different directories, if you would like to use multiple domains for your site please ask us and we will point the first 5 for free, thereafter there will be a £5 set up fee per domain, if such scripts are employed your account may be terminated.

Hacking/Cracking. Infinite Hosting reserves the right to report illegal activities to any and all regulatory, administrative, and/or governmental authorities for prosecution.

The following examples of unacceptable behaviour are non-exclusive, and are provided for guidance purposes. If you are unsure if your actions will be a violation of our policies please ask abuse@InfiniteHosting.co.uk

Server broadcast messages or any message sent on an intrusive basis to any directly or indirectly attached network. Attempt to circumvent any user authentication or security of host, network, or account. Accessing data not intended for user. Probing the security of any network. Spawning dozens of processes. Port scans, ping floods, packet spoofing, forging router information, Denial of Service attacks, sniffers, flooding, spoofing, ping bombing, smurfs, winnuke, land, teardrop. Promulgation of viruses. IRC bots such as eggdrop or BitchX. Any activity, whether or not the intrusion results in the corruption or loss of data, will be investigated and proper action taken. The presence of any of these programs, whether or not run, will result in action against the user including suspension or termination of accounts held by the user.

Client Responsibility. The client is responsible for all activity originating from the account unless proven to be a victim of outside hacking or address forgery. The client is responsible for securing their username/password. The client assumes responsibility for all material on their site, and material that may be put on by a third party (such as the usage of Free For All links pages). Use of Infinite Hosting service requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client. The following examples are offered: Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTPing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability. CGI-Scripts: requires knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, CShell scripts, permissions, etc. Mail: a use of mail clients to receive and send mail, etc. The client agrees that he or she has the necessary knowledge to create and maintain their web space. Client agrees that it is not the responsibility of Infinite Hosting to provide this knowledge or support outside matters specific to Infinite Hosting servers.

Backups. Full backups are made weekly, and incremental backups (backups of new/changed data) of data made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients' responsibility to maintain local copies of their web content any information. If loss of data occurs due to an error of Infinite Hosting, Infinite Hosting will attempt to recover the data for no charge to the client. If data loss occurs due to negligence of client in securing their account or by an action of the client, Infinite Hosting will attempt to recover the data from the most recent archive for a £50.00 fee.

IP Numbers/Addresses. Infinite Hosting maintains control and any ownership of any and all IP numbers and addresses that may be assigned to the client and reserves in its sole discretion the right to change or remove any and all IP numbers and addresses.

Limitation of Liability. Infinite Hosting shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Infinite Hosting servers going off-line or being unavailable for any reason whatsoever. Further, Infinite Hosting shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Infinite Hosting servers. All damages shall be limited to the immediate termination of service.

Infinite Hosting shall be the sole arbiter of what is and is not a violation of these acceptable use policies. Infinite Hosting reserves the right to terminate an account at any time and for any reason that causes harm to any of Infinite Hosting customer web sites. Infinite Hosting reserves the right to delete all content and files upon termination. Infinite Hosting reserves the right to withhold any pre-paid funds for any site removed for violations of these policies. Infinite Hosting reserves the right to refuse, cancel, or suspend service at our sole discretion.

Infinite Hosting reserves the right to change the Acceptable Use Policy without prior notice or warning. Non enforcement of any part of the Acceptable Use Policy does not constitute consent.

Violations of these Acceptable Uses Policies should be referred to abuse@InfiniteHosting.co.uk, all complaints will be investigated promptly.
